General Terms and Conditions of Business of the company Upper Class GmbH for shop.upperclass.ch

Scope
These General Terms and Conditions of Business apply to the purchase of products in the E-Shop of the company Upper Class GmbH
and for all information, documents, graphics, films for which music and/or other services which are rendered for you in the E-Shop or by Upper Class GmbH.

The drawings, depictions, images, pattern collections, details, technical data, dimension and performance descriptions shown by Upper Class E-Shop are non-binding and may deviate from the final product. Product amendments remain reserved.

In order to make full use of Upper Class E-Shop, which also includes the placing of articles in the shopping cart and the payment procedure, you must ensure that your browser settings permit both cookies as well as pop-ups.

Contractual conclusion and withdrawal
By virtue of the presentation of our goods, you are invited to submit a purchase offer in the form of an order. If we accept your offer or your order, then as a rule you will receive an e-mail confirmation within one hour. We shall of course also inform you by e-mail if we are not able to accept your order.

If the goods are not available, despite the acceptance of your order, then we shall be entitled to withdraw from the agreement. In this event we undertake to inform you without delay about the non-availability of the ordered goods; if your credit card, your PayPal account or your bank account has already been debited, then we shall reimburse the payment price without delay. Order quantities must correspond to standard household quantities.

Delivery and shipping charges
Delivery shall be to the delivery address specified by the ordering party. For the respective shipping charges and delivery periods, please see the current table on our website under the section Shipping/Returns. All deliveries shall be made using the Swiss Post Office. Please note that all information pertaining to delivery periods has been provided without obligation for Upper Class E-Shop, unless a fixed delivery date has been agreed.

Payment
All prices include statutory value added tax. Payment may be performed using a credit card issued by one of the following companies American Express, MasterCard and Visa, as well as by prepayment. If you pay by prepayment you have five working days of time to place the payment. If the money is not on our bank account after these five days your order will be deleted.

Payment by credit card will be settled by the company Six Multipay Switzerland.

The goods shall remain our property and shall not be dispatched before payment has been received in full.

Return
You may return the received goods, without the need to specify a reason, by sending these back within 14 days. For this purpose, the supplied return form must be used. The return costs must be borne by the ordering party. The punctual dispatch of the goods shall ensure adherence to the deadline for the return of goods (postmark).

In the event of the effective return, the reciprocally-received performances must be returned, and any possible benefits (e.g. utilisation benefits) must be surrendered. If the goods have deteriorated, compensation may be demanded for the fall in value. This shall not apply if the deterioration in the goods is exclusively attributable to their inspection – as might have been possible for example in a retail outlet. In other respects, you may avoid the obligation to provide compensation for the fall in value by not using the goods by refraining from using the goods in the manner of an owner, and by taking care not to impair their value. The returned goods must be packed in the original packaging, and must be labelled with the product labels. If you exercise your right of return, the purchase agreement shall lapse at the time of the receipt of the goods at Upper Class E-Shop.

Contributions
If you send ideas, remarks, questions, data, graphics or similar to Upper Class E-Shop CH, then these shall become the exclusive property of Upper Class GmbH. The contributions shall not be considered to be confidential, and we may use or publish these in any manner possible, without obligations or informing you. The contributions or any other type of information which you send to us should not constitute or contain any offensive, pornographic, defamatory, blasphemous or unlawful material that breaches any existing law, whether civil, criminal or religious. You confirm that all the material which you send to us is your property, and that you have not copied this wholly or in part from any third party. Please do not send us any material which is to be handled confidentially.

Reservation of title
We reserve the title to the object of the purchase, up until the comprehensive payment of all claims arising out of the delivery agreement.

Defect warranty and liability
The guarantee period for all products available for purchase at Upper Class E-Shop CH is 12 months from the day on which the goods leave our premises. In the event of a guarantee claim, the products must be presented directly to Upper Class. The cost of return consignments shall be borne by the customer. The guarantee extends to all defects which appear during the agreed guarantee period, insofar as these are demonstrably attributable to poor material or defective manufacture. At the choice of the guarantor, the liability shall however be limited to the repair, the replacement or the reimbursement of the invoice sum of the defective goods. Further claims of the buyer shall be excluded. In particular, Upper Class shall not be liable for damages attributable to improper utilisation or natural wear, or for damages which do not arise in the object of the delivery itself (consequential harm caused by a defect). Any amendments or repair work performed without our consent or the written consent of the manufacturer as well as failure to adhere to the General Terms and Conditions of Business shall abrogate the warranty liability.

Data protection
All personal data shall be handled in a confidential manner. The data required to settle the business transaction shall be stored and shall be forwarded to affiliated companies only within the framework of the settlement of the order.

Applicable law and place of jurisdiction
All legal agreements are governed exclusively by Swiss law.
The place of jurisdiction is Zürich.
